Only a single private dwelling or single family residence designed for the occupancy of one family shall be erected or maintained on any lot in “Indian Hills Estates” and shall not be used for any purpose other than residential.
No residence or dwelling shall be erected or maintained on any lot in “Indian Hills Estates” which has an appraised value of less than $40,000, excluding land value and value of all auxiliary buildings or garage. A single family residence designed for the occupancy of one family shall be erected or maintained on any lot in “Indian Hills Estates” and shall not be used for any purpose other than residential.
No fence, wall, hedge or tree shall be created, located, planted or maintained upon any lot in a manner which would unreasonably restrict the view from any lot or lots. Maximum height of any wall, fence, or hedge shall be six feet from existing ground level.
No noxious or offensive activity shall be carried on with any lot, nor shall activity be done through which may be or become an annoyance or nuisance to a resident or to the neighborhood.
No building or structure shall be moved onto any lot in this plat from any land outside of said plat, except a new prefabricated structure of the quality and value herein required. No structure of a temporary nature, trailer, basement, tent, shack, garage, barn or other out-building shall be used on any lot at any time as a residential structure, either temporary or permanent.
No animals, livestock or poultry of any kind shall be raised, bred or kept on any lot except household pets. Pets over 4 months of age, except caged birds, shall be limited to 2 in number, provided that said household pets are properly cared for.
No commercial venture or business shall be conducted on any lot, except that of dressmaking, private babysitting, individual music lessons or a similar activity or profession may be conducted by a resident of the household, provided that the privacy of adjoining householders is not disturbed. This is not to be construed to permit barber shops, beauty shops, or other service type businesses to be operated in this plat.
The work of construction of all buildings and structures shall be executed diligently and continuously so that not more than one year elapses from commencement to completion of exteriors, including painting or other suitable finish. All buildings or structures shall be new construction. Exterior finish shall be of wood, stone, brick, glass, concrete or like material and no imitations thereof may be used.
Mechanical repairs to the family car, boat, or similar equipment performed outside shall be completed within twenty days. If repairs are not then completed, such vehicle or piece of equipment shall be moved into a garage or removed from the premises.
No lot shall be used or maintained as a dumping ground for rubbish, waste or junk of any kind. All incinerators or other equipment for the storage or disposal of waste shall be left in a clean and sanitary condition. No building materials of any kind shall be placed or stored upon any lot until the owner is ready to commence construction. Building materials shall be placed within the property line of the building site upon which a residence is to be constructed and not in the street.
No trailers, mobile homes, or temporary structures shall be placed upon any lot.
Lots 18, 19, 20, 21, 22, 23, 24, 25, 26, 27 28, 29, 30, 36 and 37 are subject to a 50 foot buffer (no vegetation shall be removed) along the east boundary of said lots.
Invalidation of any one of the covenants herein contained by judgment or court order shall in no way affect any of the other provisions hereof, which shall remain in full force and effect.
These covenants and restrictions shall run with the land and be binding upon those persons residentially owning property within this plat, and all future owners, their heirs, executors or assigns.
